Services provided by Symphera

The educational service provided by Symphera is training or a seminar, hereinafter referred to as a course. A course may be delivered by instructors presenting materials in a classroom or online. To ensure the highest quality, the number of participants in each course is limited. If the number of registrants exceeds the number of available seats, Symphera will select participants in the order in which registrations were received.

Courses are delivered in English or Czech. The language, basic content, duration, venue, and required participant knowledge for a given course are defined in the individual course descriptions. Course content may differ from the basic description depending on the needs and knowledge level of the participants.

Course materials are literary or other copyrighted works, including documentation, manuals, machine-readable instructions, components, data, and audiovisual content (such as images, text, recordings, or pictures), along with related licensed materials. Course materials are the property of Symphera or its partners and are protected by copyright and licenses. The same terms that apply to the original apply to any full or partial copies of the course materials.

Booking and orders

By registering for a course, the participant unconditionally agrees to these General Terms and Conditions of Education for Symphera. A course can be booked by completing the registration form (by email, via web registration) or by sending a company order. The registration is not valid until Symphera confirms it in writing. If a course is fully booked, Symphera will offer participation on an alternative date.

Organizational information about the course

Participants will receive an invitation with information about the course venue, time, and organization no later than 5 days before the course starts. The course will begin on the date and at the venue stated on the confirmed registration. Courses start at 9:00 AM and end at 5:00 PM unless stated otherwise. Training rooms open 30 minutes before the course starts. Breaks are scheduled by the trainer in agreement with the participants.

Price and billing

The price of the course per person is stated in the course overview. Course prices are given in CZK. VAT will be charged on top of the course price according to applicable regulations. An invoice will be issued and sent to the participant no later than three business days after the course.

Changes to course attendance

• Rescheduling a course 4 weeks or more before the start of the ordered course – no fee.
• Rescheduling a course 4 weeks to 2 weeks before the course starts – 20 % of the total course price.
• Rescheduling a course 2 weeks or less before the course starts – 30 % of the total course price.

Cancelling course attendance

• Cancelling a course more than one month before the course – 10 % of the total course price (administrative fee).
• Cancelling a course one month to 3 weeks before the course starts – 50 % of the total course price.
• Cancelling a course within 3 weeks or less before the course starts – 100 % of the course price.

Failure to attend the course

Non-attendance without prior notice – a fee of 100% of the total course price.

Substituting a participant

The customer may replace a course participant who has a confirmed registration with another person, with sufficient and recommended advance notice.

Rescheduling or cancellation of the course by Symphera

Symphera reserves the right to move the date of a course or to cancel a course for reasons beyond its control (force majeure, a sudden power outage, trainer illness and the like). Symphera also reserves the right to cancel a course if too few customers have registered 7 business days before it starts. If a course is cancelled, a new date will be agreed with the registered participants. If no new date can be agreed, the participation fee will be refunded.

Courses held at the customer's premises

If a course is organized exclusively for a single customer, i.e. on a custom basis, a different venue than the usual training premises and a different date than the one listed in the course catalog may be agreed. In such a case, the customer will provide a suitable classroom and technical equipment, where required, and will not exceed the specified number of trainees.

Symphera's liability

Symphera bears no liability for the conduct of course participants outside the course.

Contract

The accepted registration form or order, or confirmed email correspondence acknowledged by Symphera, together with these General Terms and Conditions, constitutes the complete agreement between the parties for the provision of the specified course. This agreement may only be amended by written addenda signed by both parties.

Copyright and intellectual property protection

All course content and the materials provided with it by Symphera are intended solely for the personal use of the participants named by the customer. Symphera reserves all rights to them. Without Symphera's prior written consent, no part of the training materials may be reproduced — in particular by means of data processing systems — copied, distributed or used for internal or external duplication in any form. This provision remains in force after the course ends. Participants may not record the courses in any way.

Changes to the General Terms and Conditions

Symphera may propose a change to these terms by means of written notice. If the customer does not cancel their registration or order before the amended terms take effect, the amended terms will apply to them. In all other cases, a change to the terms will only take effect once agreed in writing by both parties. Any additional or different terms stated in a customer's order or communication are invalid.

General provisions

Any addenda, amendments, or changes are valid only if made in writing. These General Terms and Conditions are governed by the laws of the Czech Republic, regardless of any conflict-of-law provisions. Any disputes arising from these General Terms and Conditions or in connection with any contract governed by them will be finally settled by the courts in Prague or Brno, Czech Republic.
